Welcome to Vaya!

These terms and conditions of use (the "Terms of Use") govern your use of the Vaya platform (the "Platform"), which is owned and operated by Anuvaya Technologies.

Please read these Terms of Use carefully before using the Platform. By accessing or using the Platform, you ("you" or "User") agree to be bound by these Terms of Use. If you disagree with any part of the Terms of Use, then you may not access the Platform.

1. User Representations and Obligations

  • Eligibility. By using this Platform, you warrant that you are over the age of 18 years and are legally capable of entering into binding contracts.

  • Account Registration. To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You agree to immediately notify us of any unauthorised use of your account. You agree that you will use your account on the Platform to make purchases only for personal use and not for business purposes.

  • Accurate Information. You agree to provide accurate and complete information when creating an account and to keep your account information updated. You acknowledge that if you provide any false or misleading information, Vaya has the right to suspend or terminate your account.

  • Prohibited Activities. When using the Platform, you agree not to:

    • Violate any applicable laws or regulations.

    • Infringe upon the intellectual property rights of others.

    • Transmit any harmful content, including viruses or other malicious code.

    • Interfere with or disrupt the Platform or servers or networks connected to the Platform.

    • Attempt to gain unauthorised access to the Platform or any related systems or networks.

  • User Content. You are solely responsible for any content you post or submit to the Platform ("User Content"). You represent and warrant that you own all rights to your User Content or have obtained all necessary licenses and consents to provide the User Content to the Platform. You grant Vaya a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Platform. The website is not a suicide helpline platform. You agree not to use the platform for any unlawful or prohibited activity, including attempting to purchase Vaya services for business purposes.

2. Intellectual Property Rights

  • Ownership. The Platform and its content, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, are the property of Vaya or its licensors and are protected by copyright and other intellectual property laws.

  • Limited License. Vaya grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use. This license does not include any resale or commercial use of the Platform or its content; any collection and use of any product listings, descriptions, or prices; any derivative use of the Platform or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

  • Restrictions. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Platform. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Vaya without express written consent. You may not use meta tags or any other "hidden text" utilizing Vaya name or trademarks without the express written consent of Vaya.

3. Disclaimer of Warranties; Limitation of Liability

  • Disclaimer of Warranties. The Platform and all information, content, materials, products (including software) and other services included on or otherwise made available to you through the Platform are provided by Vaya on an "as is" and "as available" basis, unless otherwise specified in writing. Vaya makes no representations or warranties of any kind, express or implied, as to the operation of the Platform, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the Platform, unless otherwise specified in writing. You expressly agree that your use of the Platform is at your sole risk.

  • No Guarantees. To the fullest extent permissible pursuant to applicable law, Vaya disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Vaya does not warrant that the Platform, information, content, materials, products (including software) or other services included on or otherwise made available to you through the Platform, Vaya's servers or electronic communications sent from Vaya are free of viruses or other harmful components. Vaya will not be liable for any damages of any kind arising from the use of the Platform or from any information, content, materials, products (including software) or other services included on or otherwise made available to you through the Platform, including, but not limited to direct, indirect, incidental, punitive and consequential damages, unless otherwise specified in writing.

  • Third-Party Content and Services. The Platform may include links to third-party websites or services that are not owned or controlled by Vaya. Vaya has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Vaya shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

  • Astrologer Services Disclaimer. The astrologers listed on the Platform are independent contractors and are not employees or agents of Vaya. We do not control or vet the content of consultations, nor do we guarantee the accuracy, completeness, or usefulness of any information provided by astrologers. Any advice, guidance, or recommendations provided by an astrologer are solely the views of that astrologer and should not be construed as professional advice. You are required to make full disclosure about the emotional, mental and physical state of the person seeking advice from the panel of astrologers of the Platform, so that the astrologers can make an informed judgment about giving advice. You acknowledge that consultations with astrologers are for entertainment purposes only and should not be considered a substitute for professional advice. The services offered are strictly not meant to replace any philosophical, emotional or medical treatment.

4. Indemnification

You agree to indemnify, defend and hold harmless Vaya, our subsidiaries, affiliates, and licensors and their respective officers, agents, partners and employees, from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Platform, your violation of these Terms of Use or your violation of any rights of another.

5. Governing Law and Dispute Resolution

These Terms of Use and your use of the Platform will be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms of Use or your use of the Platform will be submitted to the exclusive jurisdiction of the courts located in New Delhi, India.

6. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will cease immediately.

7. Entire Agreement

These Terms of Use constitute the entire agreement and understanding between you and Vaya and govern your use of the Platform, superseding any prior or contemporaneous communications and proposals, whether oral or written, between you and Vaya.

8. Severability

If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

9. Waiver

Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of those rights or provisions.
